1. Acceptance of Terms

By downloading, installing, or using Habit Fusion ("the App"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, do not use the App.

2. Description of Service

Habit Fusion is a habit tracking application that allows you to create, schedule, and track habits on your iOS device. The App provides features including habit scheduling, progress tracking, streaks, achievements, reminders, timer sessions, widgets, and optional premium features through a paid subscription.

3. User Accounts

The App does not require account creation, login credentials, or personal registration. All data is stored locally on your device.

4. Subscriptions and Payments

Habit Fusion offers a premium subscription ("Habit Fusion Pro") that unlocks additional features. Subscription plans and pricing are displayed within the App and may vary by region.

• All payments are processed through the Apple App Store.
• Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period.
• Your Apple ID account will be charged for renewal within 24 hours prior to the end of the current period.
• You may cancel your subscription at any time through your Apple ID account settings. Cancellation takes effect at the end of the current billing period.
• No refunds are provided for the unused portion of a subscription period, except as required by applicable law or Apple's refund policies.
• You can restore your previous purchases at any time through the App's Settings.

5. Acceptable Use

You agree to use the App only for its intended purpose of personal habit tracking. You agree not to:

• Reverse engineer, decompile, or disassemble the App.
• Modify, adapt, or create derivative works based on the App.
• Use the App for any unlawful purpose or in violation of any applicable laws or regulations.
• Attempt to gain unauthorized access to the App's systems or infrastructure.
• Use the App in any manner that could damage, disable, overburden, or impair its functionality.

6. Intellectual Property

All content, design, graphics, code, and other materials in the App are owned by Paraschiv Arthur and are protected by applicable intellectual property laws. "Habit Fusion" and associated branding are trademarks of Paraschiv Arthur. You are granted a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes.

7. User Data and Content

7.1 Ownership

You retain ownership of all habit data, notes, and content you create within the App.

7.2 Data Responsibility

You are solely responsible for backing up your data. We recommend using the built-in export feature regularly to maintain backups. We are not responsible for any loss of data due to device failure, App deletion, or any other cause.

7.3 Data Portability

You may export your data in JSON format at any time through the App's Settings.

8. Disclaimer of Warranties

THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that:

• The App will meet your specific requirements or expectations.
• The App will be uninterrupted, timely, secure, or error-free.
• The results obtained from using the App (including habit tracking, streaks, or achievements) will be accurate or reliable.
• Using the App will guarantee the formation, maintenance, or success of any habit.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL PARASCHIV ARTHUR BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, LOSS OF PROFITS, OR LOSS OF GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE APP.

Our total liability for any claims arising from or related to the App shall not exceed the amount you paid for the App or its subscription in the twelve (12) months preceding the claim.

10. Indemnification

You agree to indemnify and hold harmless Paraschiv Arthur from any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising from your use of the App or your violation of these Terms.

11. Modifications to the App

We reserve the right to modify, suspend, or discontinue the App (or any part thereof) at any time, with or without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuation of the App.

12. Changes to These Terms

We may update these Terms from time to time. The updated version will be indicated by an updated "Last Updated" date. Your continued use of the App after any changes constitutes acceptance of the new Terms.

13. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Romania, without regard to its conflict of law provisions.

15. Apple's Terms

Your use of the App is also subject to Apple's Terms of Service and the Apple Media Services Terms and Conditions. In the event of any conflict between these Terms and Apple's terms, Apple's terms shall prevail with respect to your use of the Apple App Store.
